Abstract: Mediation has emerged as a fundamental pillar in the United Arab Emirates’ (UAE) evolving dispute resolution landscape, offering an efficient and amicable alternative to litigation and arbitration. This article provides a comprehensive analysis of the UAE’s mediation framework, examining its historical roots, legislative advancements, and institutional mechanisms. The article explores the legislation on mediation at the federal and emirati levels as well as the role of key mediation institutions, including the Dubai International Arbitration Centre (DIAC), the Center for Amicable Settlement of Disputes (CASD), and the mediation frameworks within the Dubai International Financial Centre (DIFC) and Abu Dhabi Global Market (ADGM).
The article also delves into the challenges hindering the widespread adoption of mediation, as well as measures to enhance and strengthen the mediation framework in the UAE. By assessing mediation’s trajectory in the UAE, this article highlights its aim to become a regional and global leader in mediation.
